Summary To be read in conjunction with the our standard terms and conditions Accepting our supply of LPG means you agree to be bound by these conditions unless other conditions have been agreed to by us in writing. Definitions: 'You' & 'your' means our customer and when we open your account means the persons named in that account. 'We', 'us', 'ours' mean Eureka Gas, its employees, agents, or contractors. 'LPG' means the liquefied Petroleum Gas we deliver to your premises. 'Delivery Day' means the day of the week that we deliver LPG to a particular area. 'Service Charge' means the amount you pay us in advance for borrowing our equipment and the maintenance of it . 'Notice' means any advice or information we give to you either by phone or in writing, i.e. on our invoices, delivery dockets, or statements. If in writing it will be effective when posted to you at your premises.
LPG Supply: We will supply LPG to you either: 1. On Schedule, where we visit your premises on a set frequency whether it be weekly, fortnightly, monthly etc. Each time we visit we will replace any LPG that has been used. There is no "on schedule" delivery fee. 2. On Call, where you call us when you need LPG. When we receive your call we will book in a delivery to you for the next available delivery day. Example: if you call us on a Thursday but our deliveries to your area are on a Wednesday, we will arrange your delivery for the following Wednesday. When you arrange an "on call" delivery on our scheduled day for your area, there is no delivery charge. 3. On Demand, where you call us and request a delivery on a non-scheduled delivery day. We cannot guarantee "on demand" requests as our delivery trucks may not be operating in your area, however where we are able to meet your request for an "on demand" delivery an on-demand fee will apply in addition to the price of the LPG. Our pricing to you will reflect the quantity of LPG you have informed us that you require. Unless we have agreed in writing to only supply a specific quantity of LPG to you, your LPG requirement will be deemed to include all your LPG requirement. Whilst we will use our best endeavors to deliver LPG in a timely fashion, you will not hold us liable for consequential damages in the event that you have inadequate supplies of LPG. We may ration our available supplies of LPG if there is a current or foreseeable supply shortage.
Equipment and Safety: You may borrow our equipment. Where we do this we will deliver it to you (or you may collect it from us) and we will maintain it in good working order in accordance with our maintenance procedures and statutory requirements. You will take care of our equipment and keep it secure. You will not move it from its original location without our written consent. You will not obscure it or otherwise make access difficult. You will not add to or remove any of its components. You will not lend our equipment to any other person without our written agreement. If you do so you will remain liable for the replacement cost of the equipment until you return it. You will be responsible for any loss or damage to our equipment. We recommend that you insure our equipment against loss or damage. You will pay the cost of the return of the equipment to us. You agree: 1. to use the LPG and equipment carefully, safely, lawfully, and in accordance with our safety directions 2. to provide a safe, lawful, and secure site for the LPG 3. to immediately contact us in the event of a gas leak from our equipment 4. to only use Eureka Gas LPG to refill our equipment 5. to give us at least 30 days written notice before you vacate your premises. If you fail to do this and we are required to arrange the removal of our equipment from the original or subsequent location you will bear the cost of this. 6. to preserve our ownership of our equipment and not relocate it to anywhere else on or away from your premises 7. to allow us reasonable access to our equipment on your premises at all times 8. that ownership of LPG delivered to you is ours until paid for in full, however risk in the LPG is yours upon delivery of the LPG to your premises We may not deliver LPG to you if you breach any of the terms of our agreement
Payment and Price: You agree to pay us at the rates we invoice you for the LPG, Service charge, and Security deposit, and where required, for equipment connection, re-connection, and disconnection, in addition to any applicable special fee. Details of these fees can be found here. We may change your LPG price and our equipment and other fees from time to time in line with variations in our costs, changes to your requirements in terms of the volume of LPG you require, and changes to local supply conditions. Any changes will be communicated to you with your next invoice or at any time you make a request. The price for LPG and services supplied to you will be those prevailing at the time of delivery. You agree to pay us the amount you owe us by the due date. Payment may be required at the time of order unless otherwise agreed by us in writing. If you have an account with us that is overdue, supply of LPG may cease until your account is brought back into terms. Our management of overdue accounts may incur costs which will be billed to you. In some cases we may also require you to prepay for future LPG supplies.
Ending your LPG Supply Agreement: If you have borrowed equipment from us your supply agreement will be for a specific period of time; this is stated on your supply agreement. Where we lend equipment to you we require it to be exclusively in use with our LPG supply for the length of your supply agreement with us, in order to justify our investment in the equipment and resources to support your consumption. When your supply agreement expires it will roll over into another supply period unless you or us elect to terminate it (refer to your individual agreement). To finalise termination of our agreement you must first pay all monies owing to us. If you terminate the supply agreement in accordance with the terms of the agreement we will remove our equipment from your premises at no cost to you, provided that the equipment is made accessible to us at our nominated collection day/time. If you terminate our agreement before its expiry date you will be responsible for the cost of removing the equipment and returning it to our premises. The equipment will continue to attract service charges until returned. These costs will be deducted from any security deposit we hold until depleted and then invoiced to you.
